§ 199.1 Repealed Regulations Effective March 1st 2016.p.2

The following regulations, regulation circulars and regulatory guides are repealed effective the coming into force date of these General Authority of Civil Aviation Regulations (GACAR) as stated in GACAR §199.3(a):

(a) GACAR Parts 1, 2, 3, 4, 5, 7, 9, 11, 13, 21, 23, 25, 26, 27, 29, 31, 33, 34, 35, 36, 39, 43, 45, 47, 60, 61, 64, 65, 66, 67, 71, 77, 91, 93, 97, 99, 101, 103, 105, 109, 117, 119, 121, 125, 129, 133, 135, 139, 141, 142, 143, 144, 145, 147, 149, 151, 170, 171, 172, 173, 175, 179, 183, 193 and 199 come into force on March 1, 2016.

§ 199.11 General.p.7

(a) This subpart prescribes provisions for the orderly transition to the General Authority of Civil Aviation Regulations (GACAR). These transition provisions commence on the coming into force date prescribed in GACAR §199.3. Except as provided in paragraph (b) of this section, if no transition provisions are prescribed in any applicable paragraph in GACAR §199.13 then full compliance with the GACAR is required as of the coming into force date of these regulations.

(b) Persons who have made an application for an air operator certificate under Chapter G of the GACAR or an air agency certificate under Chapter I of the GACAR prior to the coming into force date for applicable regulations, as prescribed in GACAR §199.3, will be assessed by the GACA on a case-by-case basis to determine, what, if any, transitional provisions will be permitted.

(c) Persons who have previously been granted approval to develop instrument flight procedures under regulatory provisions in effect prior to the coming into force date of GACAR Part 172, and have commenced work on the development of instrument flight procedures for applicability in KSA, will be permitted to make design submissions for a period not exceeding nine (9) months from the coming into force of GACAR Part 172 in the case of a design organization, and twenty four (24) months from the coming into force of GACAR Part 172 in the case of individuals. Design assessments will be conducted in accordance with the provisions of GACA Part 172.

§ 199.13 Transitional Provisions.p.7

The term "new requirement" as used in this section means any regulatory provision contained in the GACAR that was not contained in the predecessor regulations that were repealed under

GACAR § 199.1.p.7

(a) GACAR Part 5 - Safety Management Systems: (1) The phased implementation of Safety Management Systems (SMS) for existing certificate holders and other service providers required to have an SMS, and applicants who submit their initial application for certification prior to the coming into force date of GACAR Part 5, is permitted according to the following four levels (phases) and prescribed exit criteria for the satisfactory achievement of each level (phase):

(i) Level 1 - Planning & Organizing SMS implementation. Level 1 exit criteria must be achieved in a manner acceptable to the President within 6 months of the coming into force date of GACAR Part 5. (ii) Level 2 - Reactive Processes, Basic Safety Risk Management. Level 2 exit criteria must be achieved in a manner acceptable to the President within 10 months of the in-force date of GACAR Part 5.

(iii) Level 3 - Proactive/Predictive Processes, Looking Ahead. Level 3 exit criteria must be achieved in a manner acceptable to the President within 16 months of the coming into force date of GACAR Part 5.

(iv) Level 4 - Continuous Improvement, Continued Assurance. Level 4 exit criteria must be achieved in a manner acceptable to the President within 21 months of the coming into force date of GACAR Part 5.

Note - The President has published an SMS Advisory Circular that has full details on each level (phase) of implementation and the prescribed exit criteria. (2) The phased implementation must also need to address all supplementary SMS requirements in the applicable appendices to GACAR Part 5. Specifically the following programs must be in place by the end of Level 2 and fully operational by the end of Level 4:

(i) Flight Data Analysis Program (FDAP) for those commercial air operators under GACAR Part 121 of airplanes > 27000 kg maximum takeoff mass; (ii) Flight safety documents system for all commercial air operators under GACAR Part 121 or Part 135;

(iii) Local runway safety program for all aerodromes under GACAR Part 139. (3) All applicants who submit their initial application for certification after the coming into force date of GACAR Part 5 must meet full compliance with GACAR Part 5 at time of initial certification.

(4) Each certificate holder conducting operations under GACAR Part 121 or GACAR Part 135 and GACAR Part 139 prior to the effective date of the family assistance program requirements of GACAR §5.27(c) must submit a family assistance plan to the GACA within 90 days of the effective date of GACAR §5.27(c). Acceptance of the plan must be obtained with 6 months of the effective date of GACAR §5.27(c).

(b) GACAR Part 7 - Problematic Use of Psychoactive Substances: Prevention and Safety Programs: (1) Existing affected certificate holders are permitted a grace period of 34 months from the coming into force date of GACAR Part 7 to achieve full compliance with GACAR Part 7.

(c) GACAR Part 21 - Certification Procedures for Products and Articles: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing airworthiness certificates remain valid until expiry. Airworthiness certificates will be issued in the new format at the time of renewal or replacement.

(2) Unless suspended, surrendered or cancelled/revoked, existing supplemental type certificates and repair design approvals remain valid. (d) GACAR Part 45 - Identification and Registration Marking: (1) Owners and operators are permitted a grace period of 60 months from the coming into force date of GACAR Part 45 to achieve full compliance with the registration marking requirements for the underside of the wing.

(2) Owners and operators are permitted a grace period of 12 months from the coming into force date of GACAR Part 45 to achieve full compliance with the new requirement to mark the aircraft registration marks on a fireproof identification plate which must be attached to the aircraft.

(e) GACAR Part 47 - Aircraft Registration: (1) Reserved. (f) GACAR Part 60 - Flight Simulation Training Devices and Aviation Training Devices: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing FSTD and ATD approvals remain valid for 12 months from coming into force date for GACAR Part 60.

(2) New FSTD SOQ certificates and sponsor SQMS approvals must be issued within 12 months of coming into force date of GACAR Part 60. (3) New ATD approvals must be issued within 12 months of coming into force date of GACAR Part 60.

(g) GACAR Part 61 - Certification: Pilots, Flight Instructors, Ground Instructors and Flight Engineers: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing airman certificates, ratings and authorizations remain valid until expiry. Airman certificates will be issued in the new format at the time of renewal, replacement or amendment.

(2) Reserved. (h) GACAR Part 64 - Certification: Air Traffic Controllers: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing airman certificates, ratings and authorizations remain valid until expiry. Airman certificates will be issued in the new format at the time of renewal, replacement or amendment.

(2) Reserved. (3) Applicants may present a graduation certificate from an appropriate ATCO training course of the Saudi Academy of Civil Aviation in lieu of graduation from an ATCO training school certificated under GACAR Part 144 for a 34 month grace period from the coming into force date of GACAR Part 64.

(i) GACAR Part 65 - Certification: Aircraft Dispatchers and Cabin Crew Members: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing airman certificates, ratings and authorizations remain valid until expiry. Airman certificates will be issued in the new format at the time of renewal, replacement or amendment.

(2) Reserved. (3) Applicants need not present a graduation certificate from an approved training course under GACAR Part 143 for a 34 month grace period from the coming into force date of GACAR Part 65.

(4) Cabin crew members who hold a valid authorization from GACA and are currently employed in the capacity of cabin crew member by an air operator certificated under the GACAR may apply for, and receive, a cabin crew member certificate with the appropriate aircraft class endorsement without further showing.

(j) GACAR Part 66 - Certification: Mechanics and Repairmen: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing airman certificates, ratings and authorizations remain valid until expiry. Airman certificates will be issued in the new format at the time of renewal, replacement or amendment.

(2) Existing mechanic certificate holders are grandfathered for the experience requirements for their certificates. (3) Existing repairman certificate holders with specialization in avionics and electrical systems at the aircraft level may apply for a mechanic certificate with avionics rating under "grandfathering" conversion provisions. Certificate holders must apply to the GACA in a form and manner acceptable to the President and within 12 months of the coming into force date of GACAR Part 66 for this one-time conversion provision. The President will assess the certificate holder's experience, qualifications and training when making a determination whether to convert the repairman certificate to a mechanic certificate with avionics rating.

(k) GACAR Part 67 - Medical Standards and Certification: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing medical certificates remain valid until expiry. Medical certificates will be issued in the new format at the time of renewal, replacement or amendment.

(2) Reserved. (l) GACAR Part 68 - Ground Services Personnel Work Permit: (1) Ground service providers will have until 01 January 2024 to complete the full transition to the new requirements for all employees identified under GACAR Part 68 Version 3.0.

(m) GACAR Part 91 - General Operating and Flight Rules: (1) The President will permit a 12 month grace period from the coming into force date of GACAR Part 91 to allow time for aircraft operators to install new equipment and instruments not required under the repealed general operating and flight rule regulations listed in

(2) Unless sooner suspended, surrendered, cancelled/revoked or expired, existing holders of letters or certificates of authorization for special flight operations (e.g. RVSM, MNPS) remain valid for 12 months from the coming into force date of GACAR Part 91.

(3) Unless sooner suspended, surrendered, cancelled/revoked or expired, existing holders of certificates of waiver remain valid for 12 months from the coming into force date of GACAR

(n) GACAR Part 97 - Instrument Flight Procedures: (1) The President will permit a 34 month grace period from the coming into force date of GACAR Part 97 to allow time for each approved instrument flight procedure to have a custodian certificated under GACAR Part 170 and providing instrument flight procedure services under GACAR Part 172.

(2) Unless sooner suspended, surrendered, or cancelled/revoked, existing approved instrument flight procedures remain valid. (o) GACAR Part 101 - Unmanned Balloons, Kites, Amateur Rockets, Model Aircraft, and Unmanned Aircraft Systems:

(1) The President will permit an 34 month grace period from the coming into force date of GACAR Part 101 to register and mark model aircraft as required under GACAR §103.83(b). (p) GACAR Part 103 - Ultralight Vehicles:

(1) The President will permit a 34 month grace period from the coming into force date of GACAR Part 103 to register and mark ultralight vehicles as required under GACAR §103.7. (2) The President will permit a 34 month grace period from the coming into force date of GACAR Part 103 for persons who operate an ultralight vehicle to hold an ultralight vehicle operator permit as required under GACAR §103.9.

(q) GACAR Part 109 - Transportation of Dangerous Goods by Air: (1) Air operators with authority to transport dangerous goods by air may continue to accept dangerous goods from persons approved by the President for the preparation of dangerous goods for transportation by air, but not holding a DGPC issued under GACAR Part 109, for up to 34 months from the coming into force date of GACAR Part 109.

(2) Organizations already holding approval from the President to prepare dangerous goods for transportation by air will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 109.

(r) GACAR Part 119 - Certification: Saudi Arabian Commercial and Noncommercial Operators: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing certificates and operations specifications remain valid until expiry. Certificates and operations specification will be issued in the new format at the time of renewal, replacement or amendment after full compliance with the applicable operating rules has been demonstrated.

(2) Existing operators under GACAR/FAR Part 91 and certificate holders operating under GACAR/FAR Part 121, 125 or 135 will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 121, 125 or 135, as appropriate. Existing operators and certificate holders must submit a compliance plan within 6 months of the coming into force date of GACAR Part 119 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 119. Existing operators under GACAR/FAR Part 91 that are transitioning to GACAR Part 125 must be in full compliance with the training requirements of GACAR Part 125 within 6 months of the coming into force date of GACAR Part 119.

(3) GACAR Part 125 Version (9.0) came into force on 04/08/2024. (4) Applicants for GACAR Part 125 Certificate of Authorization after 04/08/2024 will comply with the requirements of GACAR Part 125 Version (9.0).

(5) Existing GACAR Part 125 Certificate holders must comply with GACAR Part 125 Version (9.0) no later than 30/08/2025. (6) Existing GACAR Part 125 Certificate holders must submit their transition plans to GACA for evaluation and acceptance no later than 30/11/2024.

(s) GACAR Part 129 - Operations: Foreign Air Carriers: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing foreign air carrier authorizations remain valid until expiry. Authorizations will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 129 has been demonstrated.

(2) A foreign air carrier which has obtained authorization prior to the effected date of the family assistance program requirements of GACAR §129.31must submit a family assistance plan to the GACARwithin 90 days of the effective date of GACA §129.31. Acceptance of the plan must be within 6 months of the effective date of GACAR §129.31.

(t) GACAR Part 133 - Aerial Work Operations. (1) Unless sooner suspended, surrendered or cancelled/revoked, existing certificates under GACAR/FAR Part 133 and 137 remain valid until expiry. Certificates and operations specification will be issued in the new format at the time of renewal, replacement or amendment after full compliance with the applicable operating rules has been demonstrated.

(2) Existing certificate holders operating under GACAR/FAR Part 133 or 137 and existing foreign aerial work operators based in the KSA will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 133. Existing certificate holders and existing foreign aerial work operators based in the KSA must submit a compliance plan within 6 months of the coming into force date of GACAR Part 133 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 133.

(u) GACAR Part 139 - Certification and Operations: Aerodromes: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing aerodrome certificates remain valid until expiry. Aerodrome certificates will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 139 has been demonstrated.

(2) Existing certificate holders will have until 31 December 2018 to complete the full transition to the new requirements introduced under GACAR Part 139, including an updated aerodrome manual. Existing certificate holders must submit a compliance plan by 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed by 31 December 2018.

(3) Existing aerodromes that receive scheduled flights and without an aerodrome certificate will have until 31 December 2018 to complete the full transition to the new requirements introduced under GACAR Part 139. Existing aerodrome operators,must submit a compliance plan no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed by 31 December 2018.

(v) GACAR Part 141 - Pilot Schools: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing air agency certificates and operations specifications remain valid until expiry. Air agency certificates and operations specifications will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 141 has been demonstrated.

(2) Existing certificate holders will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 141. Existing certificate holders must submit a compliance plan within 6 months of the coming into force date of GACAR Part 141 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 141.

(w) GACAR Part 142 - Training Centers: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing air agency certificates and operations specifications remain valid until expiry. Air agency certificates and operations specifications will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 142 has been demonstrated.

(2) Certificates and operations specifications remain valid until expiry. Air agency certificates and operations specifications will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 142 has been demonstrated.

(3) Existing certificate holders will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 142. Existing certificate holders must submit a compliance plan within 6 months of the coming into force date of GACAR Part 142 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 142.

(x) GACAR Part 143 - Flight Engineer, Aircraft Dispatcher and Cabin Crew Member Schools: (1) Existing schools will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 143. Existing schools must submit a compliance plan within 6 months of the coming into force date of GACAR Part 143 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 143.

(y) GACAR Part 144 - Air Traffic Controller Schools: (1) Existing air traffic controller schools (e.g. the Saudi Academy of Civil Aviation) will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 144. Existing schools must submit a compliance plan within 6 months of the coming into force date of GACAR Part 144 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 144.

(z) GACAR Part 145 - Repair Stations: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing air agency certificates and operations specifications remain valid until expiry. Air agency certificates and operations specifications will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 145 has been demonstrated.

(2) Existing certificate holders will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 145. Existing certificate holders must submit a compliance plan within 6 months of the coming into force date of GACAR Part 145 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 145.

(aa) GACAR Part 147 - Aviation Maintenance Technician Schools: (1) Unless sooner suspended, surrendered or cancelled/revoked, existing air agency certificates and operations specifications remain valid until expiry. Air agency certificates and operations specifications will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 147 has been demonstrated.

(2) Existing certificate holders will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 147. Existing certificate holders must submit a compliance plan within 6 months of the coming into force date of GACAR Part 147 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 147.

(bb) GACAR Part 149 - Aviation Recreation Organizations: (1) Existing Aviation Recreation Organizations will have a 34 month grace period to complete the full transition to GACAR Part 149. Existing Aviation Recreation Organizations must submit an implementation plan within 6 months of the coming into force date of GACAR

within 34 months of the coming into force date of GACAR Part 149. (2) Reserved. (cc) GACAR Part 151 - Ground Service Providers: (1) Existing ground service providers will have until 01 January 2024 to complete the full transition to the new requirements introduced under GACAR Part 151 Version 6.0.

(dd) GACAR Part 170 - Certification: Air Navigation Services: (1) Existing air navigation service providers (e.g. the GACA ANS Sector) will have a 34 month grace period to complete the full transition to the new requirements introduced under GACAR Part 170. Existing air navigation service providers must submit a compliance plan within 6 months of the coming into force date of GACAR Part 170 or no later than 31 May 2018 that identifies all noncompliant items that they will be closing and include an implementation plan that shows how the compliance gaps will be closed within 34 months of the coming into force date of GACAR Part 171, 172, 173, 175 or 179, as applicable.

(2) Implementation of the existing air navigation service provider's safety management system may proceed in accordance with the transitional provisions afforded in paragraph (a) of this section. (ee) GACAR Part 183 - Representatives of the President:

(1) Unless sooner suspended, surrendered, cancelled/revoked or expired, existing certificates of designation (or equivalent) remain valid until expiry. Certificates of designation will be issued in the new format at the time of renewal, replacement or amendment after full compliance with GACAR Part 183 has been demonstrated.

(ff) GACAR Part 138 Certification, Authorization and Operation of Heliports: (1) GACAR Part 138: GACAR Part 138 -Version (3.0) was promulgated on 10/08/2022 to include the requirements for the Establishment, Certification, and Authorization of Heliports, Helidecks, and Shipboard Heliports in Saudi Arabia.

(2) For the purposes of this document, Existing Heliports are those heliports established before the publication of GACAR Part 138 -Version (3.0) on 10/08/2022 without being Certificated/Authorized by GACA.

(3) Owners and operators of the Existing Heliports must apply to GACA for Certification/Authorization in accordance with GACAR Part 138 the in the following phased approach manner: i. Phase 1: Identification Phase – All existing heliport owners/operators must apply to GACA in a form and manner acceptable to the President, no later than June 1st, 2025 to be identified as an Existing Heliport and be able to obtain the National Identification Code

(NIC).p.19

ii. Phase 2: Application Phase – All identified Existing Heliport owners/operators must begin the formal process of CERTIFICATION/AUTHORIZATION of their Existing Heliports as prescribed within GACAR Part 138 no later than June 7th, 2025.

iii. Phase 3: Issuance of Authorization/Certification—All owners/operators of the Existing Heliports must complete the full transition in accordance with GACAR Part 138 no later than January 1st, 2027.
